These Terms and Conditions ("Terms") govern your use of HoofHub, a web-based platform for horse agistment and management. HoofHub is operated by RDU Services Pty Ltd ("we", "us", "our"). By creating an account or using HoofHub, you agree to these Terms. If you do not agree, you must not use the platform.
1. About HoofHub
HoofHub is operated by RDU Services Pty Ltd, a company incorporated in Australia. The platform provides tools for property managers, agistees, and service providers to manage horse agistment arrangements, horse health records, property listings, and related communications.
2. Platform Role — What HoofHub Is and Is Not
HoofHub is a technology platform that provides tools to facilitate communication and management between horse property managers, agistees, and service providers.
RDU Services Pty Ltd is not:
- A party to any agreement, arrangement, or transaction made between users through or facilitated by the platform
- An agent, broker, intermediary, or representative of any user
- Responsible for the performance of any obligation agreed between users
All arrangements — including agistment agreements, service engagements, and payment obligations — are made strictly between the relevant users. HoofHub provides the tools; users are responsible for the agreements they make and the outcomes of those agreements.
3. Eligibility and Accounts
You must be at least 18 years of age to create an account on HoofHub.
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the security of your account credentials
- All activity that occurs under your account
You must notify us immediately if you suspect unauthorised access to your account. RDU Services Pty Ltd is not liable for any loss resulting from unauthorised use of your account where you have failed to keep your credentials secure.
3. User Roles and Responsibilities
HoofHub supports multiple user roles, including property managers, agistees, and service providers. Each role carries specific responsibilities.
All users must use the platform honestly, in good faith, and in accordance with these Terms.
Property managers are responsible for the accuracy of property information they publish, the management of their agistee relationships, and compliance with applicable laws in operating their property.
Agistees are responsible for the accuracy of horse records they enter and for their obligations to the properties they are associated with.
Service providers are responsible for the accuracy of any records or notes they enter and for ensuring they hold any relevant professional qualifications required to perform the services they offer.
4. Acceptable Use
You agree not to use HoofHub to:
- Post false, misleading, or defamatory content
- Harass, threaten, or abuse other users
- Attempt to gain unauthorised access to other accounts or platform systems
- Scrape, copy, or harvest platform data without permission
- Use the platform for any unlawful purpose
- Transmit spam, malware, or other harmful content
- Circumvent any access controls or subscription restrictions
We reserve the right to remove content or suspend accounts that violate these standards, at our sole discretion.
5. Messaging and Communications
The messaging feature on HoofHub is provided to facilitate coordination between users regarding agistment, horse care, and related matters. By using the messaging feature, you acknowledge that:
- Messages are stored by the platform and may be reviewed by RDU Services Pty Ltd where required for safety, legal compliance, or dispute resolution
- You are solely responsible for the content of messages you send
- RDU Services Pty Ltd is not responsible for any outcomes, disputes, or harm arising from communications between users
You are fully responsible for the content of every message you send through HoofHub. RDU Services Pty Ltd is not liable for any misunderstanding, reliance on, or outcome arising from communications between users, including but not limited to agreements made, instructions given, or expectations formed through the messaging feature. Where a dispute arises from a communication made through the platform, that dispute is strictly between the users involved.
The messaging feature must not be used for commercial solicitation unrelated to the platform's purpose, or for any purpose that violates these Terms.
6. Disputes and User Responsibilities
HoofHub connects users but is not responsible for what happens between them. This section sets out how certain situations are handled.
Disputes between users
Users are responsible for resolving any disputes between themselves directly. RDU Services Pty Ltd is not responsible for mediating, arbitrating, or enforcing agreements or arrangements made between users. We may, at our sole discretion, assist in facilitating resolution where a serious breach of these Terms is involved, but we are under no obligation to do so.
Horse injury, illness, or death
HoofHub is a platform for recording and communicating information about horses. All decisions relating to the care, health, safety, and welfare of horses remain the sole responsibility of the relevant users. RDU Services Pty Ltd is not responsible for any outcome related to the health, injury, illness, or death of any animal, regardless of whether information about that animal is stored on the platform.
Service provider issues
HoofHub does not guarantee the quality, safety, licensing, suitability, or outcome of services performed by any service provider who uses or is found through the platform. Users engage service providers entirely at their own risk. Any dispute regarding the quality or outcome of services is strictly between the user and the service provider.
Non-payment and financial disputes
HoofHub provides billing tools for tracking invoices and payments between property managers and agistees. These tools are provided for convenience only. RDU Services Pty Ltd is not responsible for enforcing payment obligations between users, recovering unpaid amounts, or resolving financial disputes. Any such disputes are strictly between the parties involved.
Misuse and abusive behaviour
RDU Services Pty Ltd reserves the right to suspend or terminate any account, remove any content, and take any other action we consider appropriate if a user engages in conduct that is harmful, abusive, or in breach of these Terms. Such decisions are made at our discretion for the protection of our users and the integrity of the platform. We are not obligated to provide prior notice before taking action, though we will do so where it is reasonable and practical.
7. Horse Records
HoofHub provides tools for entering and storing horse health and care records. You acknowledge that:
- Records are entered by users and are not verified by RDU Services Pty Ltd
- The platform does not provide veterinary, medical, or professional animal care advice
- RDU Services Pty Ltd makes no representation as to the accuracy, completeness, or reliability of any records stored on the platform
- Decisions made based on information stored in HoofHub are made at your own risk
8. Service Providers
HoofHub allows service providers (including but not limited to farriers, veterinarians, equine dentists, and other equine professionals) to create profiles and interact with horse owners on the platform. You acknowledge that:
- RDU Services Pty Ltd does not vet, endorse, or verify the qualifications, licences, insurance, or quality of work of any service provider listed on or using the platform
- Engaging a service provider found through HoofHub is entirely at your own risk
- RDU Services Pty Ltd accepts no liability for any loss, injury, death, or damage to horses or people arising from services performed by any service provider
9. Subscriptions and Payments
Free plans provide access to a limited set of features as described on the platform at the time of registration.
Paid plans unlock additional features and are billed on the cycle described at the time of purchase (monthly or annual). By subscribing to a paid plan, you authorise RDU Services Pty Ltd to charge your nominated payment method on a recurring basis.
Cancellations take effect at the end of the current billing period. You will retain access to paid features until that date. No partial refunds are provided for unused portions of a billing period, except where required by Australian Consumer Law.
Plan limits apply to certain paid tiers (such as the number of properties or agistees). Exceeding a plan limit will prevent the addition of further items until you upgrade.
VIP or complimentary plans may be assigned by administrators at no charge. These plans may be modified or revoked at any time at RDU Services Pty Ltd's discretion. Where practical, reasonable notice will be provided before a complimentary plan is changed or withdrawn, however we do not guarantee advance notice in all circumstances.
We reserve the right to change pricing or plan features with reasonable notice. Continued use of a paid plan after a price change constitutes acceptance of the new pricing.
10. Intellectual Property
All content, design, software, and materials comprising the HoofHub platform — including but not limited to the platform name, logo, interface design, and code — are the intellectual property of RDU Services Pty Ltd or its licensors.
You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You may not copy, reproduce, modify, distribute, or create derivative works from any platform content without our prior written consent.
Content you submit to the platform (such as horse records, property descriptions, and messages) remains yours. By submitting content, you grant RDU Services Pty Ltd a licence to store, display, and process that content as necessary to operate the platform.
11. Limitation of Liability
To the maximum extent permitted by Australian law:
RDU Services Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of business, injury to animals, or any harm arising from:
- Reliance on information entered by other users, including horse records or service provider profiles
- Outcomes of communications or arrangements made between users through the platform
- Services performed by service providers found on or using HoofHub
- Platform downtime, data loss, or technical errors
- Unauthorised access to your account where reasonable security practices were not followed
Our total liability to you for any claim arising out of or in connection with these Terms or your use of HoofHub will not exceed the total amount you have paid to RDU Services Pty Ltd in the twelve (12) months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or condition that cannot be excluded under the Australian Consumer Law.
12. Disclaimer of Warranties
HoofHub is provided on an "as is" and "as available" basis. RDU Services Pty Ltd makes no warranties, express or implied, regarding the platform's fitness for a particular purpose, uninterrupted availability, or freedom from errors or security vulnerabilities.
We do not warrant that the platform will meet your specific requirements or that any information on the platform is accurate, current, or complete.
13. Termination and Suspension
RDU Services Pty Ltd may suspend or terminate your account at any time if you:
- Breach these Terms
- Engage in conduct that is harmful to other users or to the platform
- Fail to pay applicable subscription fees
- Are found to have provided false information at registration
You may close your account at any time through your account settings or by contacting us. Upon termination, your access to the platform will cease. Billing records and data retained for legal purposes will be handled in accordance with our Privacy Policy.
14. Changes to the Platform and Terms
We reserve the right to modify, suspend, or discontinue any part of HoofHub at any time. We will provide reasonable notice of material changes to these Terms where practicable. Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from or in connection with these Terms will be subject to the jurisdiction of the courts of Australia.
